Welcome to Adlert, a Software-as-a-Service (SaaS) product. These Terms of Service (hereinafter "Terms") apply to your use of Adlert (hereinafter "Service"). By registering for or using the Service, you agree to these Terms. Please read them carefully.

1. Definitions

1.1. "User": any natural person or legal entity that uses the Service.
1.2. "Service": the SaaS solution named Adlert, provided by Adlert.
1.3. "Subscription": the agreement between User and Adlert for the use of the Service.
1.4. "Content": all data, texts, information, software, graphic images, or other materials provided and uploaded by Users to the Service.

2. Access to the Service

2.1. The Service is available via the internet and can be accessed at any time and from any location, provided an internet connection is available.
2.2. Adlert strives to make the Service continuously available but cannot guarantee that the Service will be accessible at all times without interruptions or malfunctions.

3. Use of the Service

3.1. Users must be at least 18 years old to register for the Service.
3.2. Users are responsible for providing accurate, complete, and current information during registration and use of the Service.
3.3. Users may not use the Service for illegal or unauthorized purposes. It is prohibited to use the Service in a manner that violates applicable laws or regulations.

Subscriptions and Payments

4.1. The Service is offered based on various subscription plans as stated on the Adlert website.
4.2. Payments for subscriptions are billed in advance and are non-refundable, except as required by law.
4.3. Adlert reserves the right to change subscription prices and features. Changes will be communicated and will take effect in the next billing cycle.
4.4. Consumers have the right to withdraw from the subscription agreement within 14 days of concluding the subscription, without giving any reason, unless the delivery of the digital service has commenced with the consumer's explicit consent.

5. Intellectual Property

5.1. All rights, titles, and interests in and to the Service, including but not limited to software, logos, trademarks, designs, and other intellectual property, remain the exclusive property of Adlert.
5.2. Users are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

6. Confidentiality and Privacy

6.1. Adlert will take reasonable measures to ensure the confidentiality of the data provided by the User.
6.2. The use of the Service is subject to Adlert's Privacy Policy, available on the Adlert website.

7. Third-Party Content

7.1. The Service may contain content from third parties or provide access to third-party websites and services (hereinafter "Third-Party Content").
7.2. Adlert has no control over and is not responsible for the content, privacy policies, or practices of third-party websites and services.
7.3. Users acknowledge and agree that Adlert is not responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such Third-Party Content.
7.4. Use of Third-Party Content is subject to the terms and conditions and privacy policies of the respective third parties.

8. Termination

8.1. Users may terminate their subscription at any time through their account settings.
8.2. Adlert reserves the right to suspend or terminate access to the Service if a User violates these Terms.

9. Limitation of Liability

9.1. Adlert is not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or other intangible losses, except in cases of intent or gross negligence.
9.2. The total liability of Adlert to the User will in no event exceed the amount paid by the User to Adlert in the twelve months preceding the incident.

10. Changes to the Terms

10.1. Adlert reserves the right to change these Terms at any time. Updated Terms will be published on the Adlert website.
10.2. Users are deemed to agree to the revised Terms by continuing to use the Service after the changes.

11. Governing Law and Disputes

11.1. These Terms are governed by the laws of the Netherlands.
11.2. Disputes arising out of or in connection with these Terms will be exclusively submitted to the competent courts of the Netherlands.
